01Using MCAPS
These Terms govern your use of mcaps.com and the MCAPS analytics, screener, wallet connection tools, and associated website functionality (the “Services”). “MCAPS,” “we,” and “our” refer to the project operating the Services, without implying that MCAPS is an incorporated company.
By using the Services, you agree to these Terms. If you cannot accept them, discontinue use. Our Privacy Policy at https://mcaps.com/privacy explains how information is handled; it does not replace any separate consent required by law.
02Eligibility and geographic restrictions
You must be at least 18 and have legal capacity to enter an agreement. If local law requires a higher age, that age applies. Someone acting for an organisation must be authorised to do so. You are responsible for ensuring that your activities are lawful where you use the Services.
MCAPS does not permit access by individuals or organisations residing, located, incorporated, or maintaining a registered office in Cuba, Iran, North Korea, Syria, Russia, Belarus, Myanmar (Burma), Venezuela, the United Kingdom, any European Union member state, or the Crimea, Donetsk, or Luhansk regions of Ukraine. Access is also prohibited where comprehensive sanctions imposed by the United Nations, United States, European Union, or United Kingdom make it unlawful.
Persons subject to applicable sanctions or restricted-party designations may not use the Services. This includes relevant OFAC designations, the U.S. Commerce Department Denied Persons List, UN Security Council listings, and equivalent applicable restrictions in Canada, the United Kingdom, European Union, and Switzerland. Do not conceal your location or identity to circumvent restrictions. We may revise eligibility rules or restrict access for compliance purposes.
03What MCAPS provides
MCAPS helps users examine market information, screen assets, and connect independently controlled wallets. The launchpad is not currently live. Descriptions of planned functionality do not promise a release date or entitlement to use it. New services may require additional terms.
Information on MCAPS is general information rather than personalised financial, tax, legal, or investment advice. Use of the Services does not establish an advisory or fiduciary relationship. Displaying an asset does not establish its legal classification, regulatory approval, or suitability for a particular user.
04Your wallet
MCAPS does not receive or control private keys, custody user assets, provide embedded wallets, or sign or execute transactions for users. A connected wallet remains under its user's control. Connecting it does not transfer asset ownership to MCAPS.
Keep recovery phrases and keys confidential. Never provide them to MCAPS. Examine wallet prompts, permissions, contract addresses, networks, and any transaction details before approval. Disconnecting a website session does not necessarily revoke an onchain permission. Wallet recovery and permission revocation depend on the wallet and relevant network, not MCAPS.
05Market information and screening
Charts, balances, prices, capitalisations, rankings, security indicators, and other displayed information depend on data sources and methodology. A screen may omit an asset or risk, show stale information, or contain an error. Comparisons may reflect different timestamps or assumptions.
Where MCAPS displays a rating or a “verified” designation, its meaning is limited to the stated checks and criteria. It is not a guarantee against fraud, technical flaws, manipulation, or loss. A score may change when data or methodology changes. Independently verify material information before making a decision; no interface can identify every risk.
06Digital-asset risk
Digital assets can lose their entire value. Reported activity can be manipulated, liquidity can disappear, and lookalike assets can use identical names or symbols. A token referring to a company or stock does not necessarily confer shares, ownership, redemption rights, or a relationship with that company.
External wallet or protocol activity may involve irreversible transfers, malicious approvals, software defects, congestion, compromised infrastructure, or unexpected execution. These risks exist even when an asset appears in an analytics interface. You remain responsible for deciding whether and how to interact with an asset. MCAPS makes no commitment to recover losses or maintain asset value.
07Costs and taxes
Any MCAPS charge for a future paid service must be disclosed before you incur it. These Terms do not establish a launchpad fee schedule. Independent wallets, networks, or protocols may impose their own charges. Their refunds and transaction reversals are subject to their own rules and technical constraints.
You are responsible for your tax reporting and payment obligations arising from your activities. Information shown by MCAPS is not a determination of your tax position.
08Responsible use
Do not use the Services to commit fraud, manipulate markets, launder proceeds, evade sanctions, impersonate others, or infringe privacy or intellectual property rights. Do not submit malware, deceptive links, unlawful material, or information you are not authorised to disclose.
Do not defeat access restrictions, falsify data, overload infrastructure, exploit security flaws, or automate activity in a way that disrupts the Services. Report suspected vulnerabilities privately to contact@mcaps.com.
Without separately approved terms and any legally required permissions, the Services may not be used to organise or promote fundraising, pooled investments, profit or revenue participation, tokenized business equity or debt, or similar investment interests. Display of market data alone does not authorise such activities.
09Submissions and moderation
If a feature allows you to submit images, descriptions, links, messages, profiles, or other material, you are responsible for its accuracy, legality, and permissions. Do not submit confidential information to public features.
You keep ownership of your material. You authorise MCAPS and supporting providers to reproduce, store, adapt formatting, distribute, and display it worldwide without royalties to operate and promote the feature to which you submitted it. This permission is nonexclusive and permits necessary sublicensing to providers. Retained backups and legally required records may remain after removal; public blockchain or independent distributed records may persist outside our control.
We may reject, hide, or remove material and limit submission features to address abuse, rights complaints, or operational risk. Publication does not mean we approve the author or asset. We do not undertake to inspect every submission.
10Team interests
People involved in MCAPS may own $MCAPS or other displayed assets, trade them, provide liquidity, or benefit financially from their activity. Such interests may conflict with a user's interests. Information and rankings should be assessed with that possibility in mind.
Participation in MCAPS does not make the team your financial adviser. These Terms do not promise disclosure of every personal holding or transaction, but do not override disclosures or conflict-management duties required by law. We may decline or restrict activities where conflicts create unacceptable risk.
11External services
Wallet applications, data providers, blockchain networks, explorers, linked protocols, and other external services have separate operators. Their own terms and privacy practices apply. MCAPS does not guarantee their performance or take responsibility for an independent operator's conduct. A link, logo, or integration alone does not imply partnership or endorsement.
12MCAPS materials and feedback
Use of the Services grants permission to access the interface for permitted purposes; it does not transfer ownership of MCAPS branding, original designs, documentation, or protected software. Do not commercially reproduce protected materials without permission. Separate licences govern any open-source components.
You permit us to use voluntarily supplied product ideas and feedback, including incorporating them into improvements, without payment or confidentiality obligations. Do not send confidential inventions as routine feedback.
Send copyright complaints to contact@mcaps.com with the work involved, the allegedly infringing location, your contact details, an explanation of your authority and good-faith claim, and your signature. We may request additional information and will handle notices as applicable law requires. This contact is not a representation that a statutory designated agent has been registered.
13Availability and access controls
We may change, pause, retire, or limit features for security, compliance, maintenance, or product reasons. Access limits may concern requests, wallets, content, or individual features. We may suspend users who breach these Terms or create material risk. We do not promise uninterrupted availability or indefinite retention of saved preferences and offchain records.
Restricting the website does not give MCAPS control over an independently operated wallet or public blockchain. Statutory notice and other mandatory rights remain applicable.
14Warranty disclaimer
As far as applicable law allows, you use the Services in their available condition, with no promise that they will meet your needs, be error-free, or remain secure and continuously accessible. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, to the extent legally permitted. This does not exclude a warranty or remedy that applicable law makes mandatory.
15Liability limits
To the extent permitted by applicable law, MCAPS and those working on or supplying the Services are not liable for indirect, consequential, incidental, special, exemplary, or punitive damages, including lost profits, lost data, or lost opportunities. The same qualification applies to claims arising from independent wallet compromise, external protocol defects, failed transfers, network disruptions, market movements, or third-party misconduct.
For claims connected with the Services, the combined aggregate liability of MCAPS and those working on or supplying the Services is limited to the greater of (a) US$100 or (b) fees you paid directly to MCAPS for interface use in the twelve months preceding the event giving rise to the claim.
These provisions do not exclude fraud, intentional wrongdoing, or any responsibility that cannot lawfully be excluded or limited. Mandatory consumer protections prevail over conflicting language.
16Claims arising from your conduct
Where applicable law permits, you must reimburse MCAPS and its contributors and providers for reasonable losses and legal costs resulting from third-party claims caused by your unlawful submissions, infringement of another person's rights, or material breach of these Terms. This obligation does not require reimbursement for our own wrongdoing or impose obligations prohibited by mandatory law.
Disputes with independent users, token issuers, or service providers should be addressed to the relevant party. Use of MCAPS does not make us responsible for resolving them or remove claims that the law preserves.
17Complaints and disputes
Contact contact@mcaps.com with the issue, relevant dates, and the resolution requested. Do not include wallet secrets. Where lawful, we ask that you allow up to 60 days for a good-faith attempt at informal resolution before commencing proceedings. This request does not suspend limitation periods, prevent urgent relief, or restrict a mandatory right to bring a claim sooner.
No exclusive jurisdiction, chosen national governing law, mandatory arbitration arrangement, or class-action waiver is established by these Terms. Applicable law determines the governing law and competent courts. Nothing here limits mandatory consumer or statutory rights.
18Updates and remaining provisions
We may revise these Terms and will update the effective date. Material changes will be notified through the website or another suitable method where required. Revised Terms govern subsequent use only to the extent validly accepted under applicable law.
If a provision is unenforceable, the remaining provisions continue where legally possible. A delay in enforcement does not waive a right. Rights in these Terms may be transferred only as permitted by law, with required notices and protections. Sections that logically continue after access ends, including intellectual property, liability, and dispute provisions, continue subject to applicable law.
